These terms and conditions (“Terms”) govern your (“you”, “your”) use of the website www.easyretail.co.uk (the “Website”) and your relationship with EasyRetail (“we”, “us”, “our”). 1. Agreement

By using the Website you agree to be bound by these Terms.

2. Amendments

We may update these Terms from time to time. Changes will be notified via a suitable announcement on the Website. It is your responsibility to check for such changes. The changes will apply to use of the Website after such announcement. If you do not wish to accept the new Terms you should stop using the Website. Your continued use after the effective date indicates your agreement to be bound by the new Terms. We may also modify or withdraw, temporarily or permanently, this Website (or any part) without notice and shall not be liable to you for any such modification or withdrawal.

3. Registration

You warrant that the personal information you provide when registering is true, accurate, current and complete in all respects and that you are not impersonating any other person or entity. You will notify us immediately of any changes by updating your account details or by contacting our customer service team at Contact us.

We will treat all your personal information as confidential and will only use it in accordance with our Privacy Policy. When you shop on this Website we will ask you to input personal details (e.g., name, email, billing/delivery addresses, and payment information) to identify you.

5. Protecting Your Security

To ensure that your payment card is not used without your consent, we may validate name, address and other personal information supplied during the order process against appropriate third-party databases. We take internet fraud seriously and may contact you to make additional security checks. By accepting these Terms you consent to such checks. All information provided will be treated securely and strictly in accordance with the UK GDPR and the Data Protection Act 2018.

6. Compliance & Website Use

You must not misuse the Website by knowingly introducing viruses, trojans, worms, logic bombs or other malicious or technologically harmful material. You must not attempt to gain unauthorised access to the Website, the server on which it is stored, or any server, computer or database connected to it; nor attack the Website via a denial-of-service or distributed denial-of-service attack. Breach may constitute a criminal offence under the Computer Misuse Act 1990. We may report any such breach to the relevant authorities and disclose your identity to them. You are responsible for configuring your IT, computer programmes and platform to access the Website and should use your own virus protection software.

7. Indemnity

You agree to fully indemnify, defend and hold us and our officers, directors, employees and suppliers harmless on demand from and against all claims, losses, costs and expenses (including reasonable legal fees) arising out of any breach of these Terms by you or any other liabilities arising out of your use of the Website or by any other person accessing the Website using your account information.

8. Third-Party Links

For convenience, the Website may include links to other websites or material beyond our control. We are not responsible for such websites or their content and do not endorse them. We will not be liable for the privacy practices or content of such websites or for any damage, loss or offence caused in connection with your use of or reliance on them.

9. Orders

• All orders are subject to acceptance and availability. If goods ordered are not available, you will be notified and may choose to wait for stock or cancel your order.
• Your order is an offer to purchase goods or services from us. We may reject such offers at any time. Any automated acknowledgement is not acceptance. A contract is formed when we (i) debit your card/PayPal account or (ii) dispatch the goods/commence services, whichever is later.
• We take reasonable care to keep order and payment details secure; however, absent our negligence, we are not liable for loss caused by unauthorised access by a third party.
• Risk in products passes to you upon delivery to the address you specified. We are not liable where you provide an incorrect delivery address or fail to collect from that address.

10. Delivery

Some couriers may require a signature. If, after a failed delivery attempt, you request the parcel be left in a safe place, this is at your own risk. For claims of non-delivery, please contact us within 30 days of the scheduled delivery date; after this period couriers may refuse to investigate.

11. Cancellation Rights (Consumers)

If you purchase as a consumer (i.e., not for business use), you have the right to cancel most online contracts within 14 days from the day you acquire physical possession of the goods, in accordance with the Consumer Contracts Regulations 2013. Please see our Returns Policy for how to cancel and return items, and for any exclusions (e.g., sealed items unsealed after delivery, perishable goods).

12. Price & Payment

• All prices include VAT where applicable and are correct at the time of entry. We may change prices at any time.
• UK deliveries: no additional taxes. Non-UK deliveries: you may be subject to import duties/taxes levied by the destination country; these are your responsibility. Cross-border shipments may be opened/inspected by customs. You are deemed the importer and must comply with local laws.
• Payment can be made by major credit/debit cards or PayPal. Payment is debited/cleared before dispatch or service provision. A nominal pre-authorisation may be placed by your card issuer.
• If an obvious pricing error is discovered before we accept your order, we are not required to sell at the incorrect price. We will contact you to reconfirm at the correct price or cancel (with full refund if already paid).
• Cardholders are subject to validation and authorisation by the issuer. If payment is refused or not authorised, we are not liable for delay or non-delivery. If a payment fails, we may reattempt after giving you at least 48 hours’ notice by email; you may cancel before reattempt.
• Discount codes: Only one code per order unless otherwise stated. Codes are subject to their own terms (including eligibility and maximum order value). If inconsistent, discount-code terms prevail.

13. Eligibility to Purchase

To purchase goods on this Website and form contracts under English law you must: (a) be at least 18 years old; and (b) register your real name, address, phone number, email address and any other requested details. By offering to purchase, you authorise us to transmit/obtain information from third parties (including updated information) to authenticate your identity, validate your card, obtain an initial authorisation and authorise individual transactions.

14. Intellectual Property

The Website content is protected by copyright, trademarks, database and other intellectual property rights. You acknowledge that material and content provided as part of the Website shall remain with us or our licensors. You may retrieve and display Website content on a screen, store it electronically on a device (not on any server or networked storage) or print one copy for personal, non-commercial use, provided all notices remain intact. You may not otherwise reproduce, modify, copy, distribute or use materials or content for commercial purposes.

15. Limitation of Liability

• Nothing in these Terms affects your statutory rights as a consumer or excludes/limits our liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.
• The Website is provided on an “as is” and “as available” basis without warranties of any kind, express or implied. We do not guarantee the security or privacy of the Website or information you provide; you assume the risks associated with internet use.
• Whilst we try to ensure material on the Website is correct, reputable and of high quality, we do not accept responsibility if it is not. We are not responsible for errors/omissions, results obtained from use, or technical problems (including interruptions). If informed of inaccuracies we will attempt to correct them within a reasonable time.
• To the fullest extent permitted by law, we will not be liable for any indirect, special, punitive, incidental or consequential damages, including without limitation economic loss, loss of profits, business, anticipated savings, wasted expenditure, loss of privacy or data, arising out of or related to the Website.

16. Severance

If any part of these Terms is deemed unlawful, void or unenforceable, that provision shall be deemed severable and will not affect the validity and enforceability of the remaining provisions.

17. Waiver

No waiver by us shall be construed as a waiver of any preceding or succeeding breach of any provision.

18. Entire Agreement

These Terms form the entire basis of any agreement reached between you and us in relation to your use of the Website and purchase of goods.

19. Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction over any dispute.

20. Food Cupboard (Category-Specific)

• We aim to keep “best before” dates accurate on the Website but cannot guarantee accuracy at all times.
• Nut content: Products may be manufactured/packed in environments where nuts are present. Ingredients are taken from manufacturers’ packaging/lists and are as accurate as those sources; we cannot be held responsible for their content.
• Returns: We cannot be held responsible for or provide refunds/exchanges on stock affected by circumstances beyond our control, including damage/neglect after delivery, or storage in unsuitable climatic conditions (e.g., heat causing items to stick/melt or appearance to alter). During hot months, goods in transit may be affected by heat; quality of taste is not impacted.

21. Competitions

• We may amend competition rules from time to time. Unless otherwise stated, these rules are incorporated into each competition. Entry constitutes acceptance.
• Employees (and their immediate families) of EasyRetail or those directly connected with organisation of a competition are ineligible.
• Competitions are open to UK residents (excluding Northern Ireland) aged 18+. Under-18s require prior parental/guardian permission if permitted to enter.
• All entries must be received by the specified closing date/time. We are not responsible for entries that are misdirected, lost, delayed or received after the closing date.
• We may disqualify entries that use improper technical means or appear fraudulent.
• We are not responsible for: (i) failure to comply with rules by the winner/entrants; (ii) disruption, delay or misdirection of entries; or (iii) server/system/network failures or inaccessibility.
• Prizes: If an advertised prize is unavailable, we may substitute a similar prize of equal or greater value. One prize per household. No cash alternative; non-transferable.
• Notification: Winners are selected at random from correct entries and notified within 28 days. Please allow 28 days for delivery. If a winner cannot be contacted or cannot take up a prize, we may dispose of the prize as we see fit. One prize per entrant/email per competition. Winners’ names available on request.
• Travel prizes: Travel arrangements are the responsibility of winners unless stated. We may require written permission for winners under 16 and require a companion aged 18+. Prizes may be restricted to certain times and must be taken within six months unless stated. Where prizes are provided by a third party, the winner must complete formalities directly with that provider; we are not responsible for third-party acts/defaults.

22. Reviews

If you submit a review, you grant us a non-exclusive, royalty-free, perpetual, irrevocable and fully sub-licensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute and display such content worldwide in any media, and the right to use the name you submit in connection with such content. You waive your right to be identified as the author and your right to object to derogatory treatment of such content. You agree to perform further acts to perfect these rights if requested.

You represent and warrant that you own or control all rights in the content you post; that the content is accurate; and that use of the content does not breach applicable guidelines and will not cause injury to any person or entity (including that it is not defamatory). You agree to indemnify EasyRetail for all claims brought by a third party arising out of or in connection with a breach of these warranties. Winners of any review competition will be notified by email; failure to respond within 20 days forfeits the prize.

23. Multibuy Offers

Multibuy offers apply only to qualifying items listed in the Multibuy area. Where goods are returned (except exchanges for faulty/defective products), we may require the return of all goods delivered as part of the Multibuy at your cost or charge you for goods retained at the full, non-discounted price.

24. Gift With Products Promotions

• Where a free gift is offered with a product, only one free gift is provided per transaction (regardless of quantity purchased). Subject to availability; we may substitute an alternative gift.
• To facilitate provision of a free gift, it may appear on our site at a nominal value. You are not entitled to purchase the free gift without the qualifying product; any such orders will be cancelled. If a free gift is dispatched in error, you must return it upon our written request.
